Limits on PUD Flexibility

Current ordinance

Appendix A, Section 56 — Planned Unit Development. The current PUD rules allow flexibility from normal ordinance standards in exchange for better design and public benefits. The problem is that the code does not clearly separate design flexibility from the city’s basic development limits.

Proposed rule

A PUD may change how a project is designed, but it may not increase how much development the property is allowed to have.

A PUD may change lot size, setbacks, lot width, building placement, parking, street layout, landscaping, and similar design standards when the change produces a better overall project.

A PUD may not increase the number of homes allowed by the Comprehensive Plan or zoning code; add uses that are not allowed on the property; reduce required commercial land, high-density housing, protected open space, infrastructure, fiscal review, or development-phasing requirements; or create development rights that would not otherwise exist.

Within an MXU Master Development Plan, a PUD may change where required uses are arranged, but it may not eliminate a required use or shift that obligation to unrelated property outside the approved plan.

Every PUD exception must identify the exact rule being changed, the exact change requested, and the specific public benefit received in return. General statements about better design, trails, landscaping, or open space are not enough.

Why change it

PUD flexibility should help the city get a better design, not give a developer more density or development rights than the adopted plan allows. In MXU areas, flexibility should determine where and how required uses are arranged—not whether those uses must be provided.

Implementation

Amend Section 56 to separate design standards that may be adjusted from core development limits that may not be waived. Require every PUD staff report to include a table showing the current rule, the requested exception, and the public benefit received. Cross-reference the MXU Project-Level Land-Use Requirements. Planning Commission public hearing → Council adoption.

Plain-language principle: A PUD is a design tool, not a density or land-use escape hatch.
