Recorded Development Obligations
Current ordinance
Appendix A, Section 56 — Planned Unit Development. The city already uses development agreements, but the code does not clearly list which promises from a large MXU project must carry forward into later phases.
Proposed rule
Every multi-phase MXU project must have a recorded development agreement. The agreement must list the approved land-use mix, the commercial and housing phasing rules, the order in which roads and utilities will be built, required street connections, park and open-space commitments, and any duties that must continue after a phase or parcel is sold.
Why change it
This makes sure the commitments used to approve the original project still apply when later phases are built or land changes ownership.
Implementation
Amend Section 56 and require the agreement before the first final plat is recorded. Planning Commission public hearing → Council adoption.
